Real Estate in Asia

In most Asian and South East Asian countries only nationals of those countries are permitted to own land. A typical exception to this rule is that a foreign subject may own a condominium within a building complex. Many investors overcome the ownership hurdle by inter alia, forming a corporation (which is also normally subject to foreign shareholding rules), using the name of a local partner, or entering into a long-term lease. Of greater risk to prospective investors is inadequate land registration systems which often indirectly create a quagmire of adverse claims and encumbrances, which are not immediately apparent when looking at what paperwork is available on the property. Unfortunately, this scenario may be exacerbated with corruption and unscrupulous land owners or possessors, who exploit the vulnerabilities of foreign investors.

WHAT KIND OF PROPERTIES SHOULD BE INVESTIGATED? There is no exception! All properties and their history require due diligence. Areas which require more attention would be those in remote locations or on islands. Large tracts of land and islands may additionally require communications with local and regional politicians for further insight into the property, the local environment, and potential vested interests which may affect one's decision to make such investment. Particularly in the Asian and South East Asian real estate markets, it is essential to research the title on a property and its history, to ensure valid ownership with no adverse claims or encumbrances.

It is not uncommon for business persons to make misrepresentations, before and after business transactions. It is also common for agents and consultants to make various representations leading to your prejudice. Regrettably, these occasions are common and the deviants escape with impunity. The machinations of policing and justice cumbersome and the Rule of Law is not applied universally as most may believe. It is for this reason that proactive due diligence becomes paramount.
